The changing landscape of safety compliance and enforcement has significantly increased the attention of manufacturers on issues of safety in their plants.
- New federal law, from Bill C-45, extends the liability of criminal negligence to all knowing persons (from Board of Directors to lead hands) should an offence take place. This furthers the legal duty of all who work within the manufacturing corporation to act upon issues.
- To ensure compliance, the Ministry of Labor has hired 200 more inspectors - effectively doubling the number of inspectors the ministry had previously.
- Occupational Health & Safety Act (OHSA) is law and as such under the General Duty Clause (Sec. 25(2)(h)) employers have an obligation to protect workers from serious and recognized workplace hazards. Even where there is no standard, employers must take whatever reduction actions are feasible to eliminate these hazards.
- It was thought that the costs for safety ran against the need for productivity. However, it has been learned that improved safety can actually optimize production.
- The Canadian Manufacturer's & Exporters Association (CME) recently documented that the average lost time workplace injury costs over $59,000 (including claim costs, repair, lost production and management time, higher WSIB fees, and lower productivity during recovery).
- The CME puts this in perspective by suggesting that if your profit margin is 10% you will need to increase your sales by $590,000 to cover the loss.
